Terms of Use

1.1. These Terms of Use (hereinafter referred to as the “Terms”) regulate the use of the online store located at https://liverys.eu (hereinafter referred to as the “online store”) and the terms of sale for digital print files (hereinafter referred to as “files”) sold through it.

1.2. The owner and operator of the online store is Autopolt OÜ (hereinafter “Autopolt”), located in Harju County, Lääne-Harju Parish, Niitvälja Village, Vana-Mõisa Road 4-11, 76624, registry code 16402947, email: info@liverys.eu.

1.3. Customers can purchase files in PDF/Ai/TIFF/EPS formats from the online store. Customers can be individuals and legal entities of legal age.

1.4. By purchasing files, the customer enters into a sales contract with Autopolt, subject to these Terms and Privacy Policy. These Terms apply to all individuals visiting the online store, and by visiting the online store, the person confirms acceptance and commitment to comply with the Terms and Privacy Policy.

1.5. By placing an order, the customer confirms that all provided information is accurate, they are a fully capable natural individual, and, when acting as a representative, they have all rights and authorizations to purchase files on behalf of the client. The accuracy of the customer’s and the customer’s representative’s confirmations is assumed, and Autopolt is not obliged to verify it.

1.6. Prices for files offered in the online store are listed in euros, and all prices include VAT.

1.7. Autopolt reserves the right to modify, supplement, replace, or delete these Terms, the Privacy Policy, the price of files offered in the online store, sales terms, and other information at any time at its discretion.

1.8. Changes and additions to the Terms, Privacy Policy, file prices, and other information take effect from the moment of making changes in the online store. If the customer placed an order before the changes take effect, the conditions applicable at the time of placing the order apply.

 

2.1. To purchase files from the online store, the customer must select the desired files and add them to the shopping cart. The customer will see the selected files and their prices in the shopping cart.

2.2. Autopolt makes every effort to keep information, including descriptions, specifications, and prices of files in the online store accurate and up-to-date. However, the customer is aware that the information in the online store is informative, file images are illustrative, and the final appearance of files may vary due to the customer’s computer monitor settings or other factors.

2.3. By confirming the order, the customer enters into a sales contract with Autopolt for the purchased files.

2.4. The customer can pay for the files using online banking, credit cards, or other payment solutions provided by Autopolt.

2.5. After completing the purchase, Autopolt sends a confirmation to the customer’s email address and provides a link to download the files to the email address entered by the customer when placing the order.

2.6. The customer has the right to modify and print the received files. It is prohibited for the customer to resell, share, or use the files in a manner that harms Autopolt’s interests.

2.7. Autopolt reserves the right to reject the customer’s order, especially if Autopolt believes that the order is placed by a person intending to resell the files or otherwise violate the Terms. Autopolt informs the customer of any changes to the order fulfillment as soon as possible.

3. The customer does not have the right to cancel the sales contract for files under the Law of Obligations Act § 53 (4).

4.1. Autopolt is responsible for the non-compliancy of the files sold to the customer with the sales terms that existed at the time of handing over the files to the customer. Autopolt is not responsible for defects that arise in the files after they have been downloaded by the customer.

4.2. In the event of non-compliant with the sales terms, the customer must submit a complaint to the email address [insert email], stating the customer’s name, contact phone number, order number, and a precise description of the non-conformity with the sales terms. The customer has the right to contact Autopolt within 7 days from the identification of the defect. Autopolt will review the complaints and respond to the customer as soon as possible but no later than 15 days from receiving the complaint.

5. The principles of processing personal data of individual customers are described in the online store’s privacy policy.

6.1. All information in the online store, including content of offers, online store design, and software, is protected by copyright according to the Copyright Act. All copyrights to materials presented in the online store belong to Autopolt or have been granted to Autopolt to the extent that allows their use in the online store.

6.2. Information in the online store may only be used for non-commercial purposes, and copying, reproducing, distributing, or otherwise transferring information to third parties without the prior written consent of Autopolt is prohibited.

 

7.1. Autopolt uses cookies in the online store to enhance user experience, collect usage statistics, ensure security, and improve marketing activities.

7.2. Cookies are small text files that store visited websites data in the client’s device memory. There are session cookies (temporary cookies) designed to enable the use of services and persistent cookies (stored on the client’s computer after closing the web browser) designed to remember the client’s choices in the online store.

7.3. Autopolt uses the following cookies:

Analytical cookies that collect information about how the online store is used, such as which content pages are visited the most or what visitors are looking for in the online store, etc. These cookies do not collect information that allows the client to be directly identified. This includes, for example, Google Analytics cookies.

Advertising cookies that help provide targeted advertisements based on the client’s interests. For example, Facebook Pixel, which allows displaying the online store’s advertisements on Facebook.

7.4. Autopolt collects statistical data of the online store using Google Firebase (analytics.google.com) for statistical analysis, and the terms of the respective environment also apply to data collection and storage.

7.5. The client can disable or delete the use of cookies in their web browser settings, but in such case, Autopolt cannot guarantee the correct functioning of the online store.

8.1. The customer is prohibited from using the online store and/or its content for illegal purposes, including phishing, sending spam, uploading viruses, or any other type of malicious software.

8.2. The customer undertakes to compensate Autopolt for direct financial damage resulting from the breach of the contract, including the Terms, by the customer.

 

9.1. All notifications and information sent by Autopolt to the customer are sent electronically to the email address entered by the customer when placing the order.

9.2. All notifications and information sent by the customer to Autopolt are sent through the email address provided in the online store or in the Terms.

9.3. The contract is valid until the obligations arising from the contract are fulfilled by the parties.

9.4. The contract is governed by the laws of the Republic of Estonia.

9.5. The parties will attempt to resolve any disputes arising from the contract through negotiations. If no agreement is reached, the dispute will be resolved in Harju County Court.

9.6. If disputes cannot be resolved through negotiations, consumer customers have the right to seek advice and clarification from the Consumer Protection and Technical Regulatory Authority (location: Endla 10A, 10122 Tallinn, www.ttja.ee) or to submit a dispute to the Consumer Disputes Committee. A complaint to the Consumer Disputes Committee can also be submitted through the online dispute resolution platform at http://ec.europa.eu/odr; the rules of procedure of the committee can be found at www.ttja.ee.
